The AIESEC Go Global Terms and Conditions
This agreement (the "Agreement") is made between:
(1) AIESECUK Ltd, a company limited by guarantee with registered number 120976 ("AIESEC UK"); and
(2) anyparticipant in the AIESEC Go GlobalProgramme (the "Go Global Programme") (each a "Participant").
RECITALS
A.The Go GlobalProgramme providesan opportunity for Participants to develop their personal and professionalskills by participating in a high quality international learning experience(each an "Internship").
B.Participants who are matched with an Internship workon professional placements for a duration of 6 weeks to 18 months, sharpeningtheir skills by undertaking practical work experience in a diverse culturalenvironment.
C.The Go GlobalProgramme aims tochallenge Participants through raising their awareness and knowledge of socialissues and different practices of the host country/territory.
D.AIESEC UK is not an employment agency and does notprovide work opportunities where the sole purpose is to earn money.
E.AIESEC cannot cater for those looking for a particularInternship in a particular country.
F.Participants cannot go on an internship within the UKor within the country of their birth (if this is outside of the UK).
G.The Go Global Programme is not intended to be anopportunity for a career move abroad nor is the Go Global Programme a vehiclefor any person to permanently leave their country of residence, and AIESEC UKdoes not encourage the extension of Internships beyond the agreed time period. If the company or organization providing anyInternship decides to employ the Participant on a permanent basis in the hostcountry and/or territory, AIESEC UK will have no role in facilitating this.
H.Whilst it is the aim for a Participant to receive asalary during the course of any Internship this is not guaranteed, with someInternships being unpaid or only offering accommodation. If a Participant receives a salary, it willlikely only cover basic living costs.AIESEC UK will not contribute toward any such salary, nor toward anycosts incurred by a Participant in connection with any Internship.
I.AIESEC UK is part of a wide network of affiliatednational organizations who operate under the name "AIESEC", butAIESEC UK is not responsible in any way for any acts or omissions of any memberof this network.
1.RESPONSIBILITIES OF AIESEC UK
The services provided byAIESEC UK to Participants are limited to the following:
1.1Application for the Internship
(a)Access to the AIESEC database via the website www.myAIESEC.net(or any other url used by AIESEC UKfrom time to time) (the "AIESECDatabase") for a period of 18 months from the date the Participant isfirst granted access to the AIESEC Database;
(b)The opportunity to attend an AIESEC UK induction programme and an outgoing preparationseminar, details of which will be given to Participants by their local AIESECUK committee (the "AIESEC HomeCommittee"), or emailed to Participants by the national AIESECcommittee for the UK (the "UK AIESECNational Committee"); and
(c)Assistance and guidance with finding an appropriateInternship through the AIESEC Database.
1.2During the Internship
(a)Provision of such information as can reasonably beobtained in respect of the hosting organisation providing the Internship (the "Hosting Organisation"), once a match has been found; and
(b)Regular communication with AIESEC UK during theInternship.
1.3After the Internship
(a)Provision of re-integration activities for allParticipants returning to the UK from Internships abroad, details of which willbe given to participants by their AIESEC Home Committee, or emailed toParticipants by the UK AIESEC National Committee.
2.RESPONSIBILITIES OF PARTICIPANT:
All Participants undertake to do the following:
2.1General
(a)Participate in the AIESEC UK induction programme, details of which will be givento Participants by their AIESEC Home Committee, or emailed to Participants bythe UK AIESEC National Committee;
(b)Inform their AIESEC Home Committee and/or the UKNational AIESEC Committee as soon as reasonably practicable if they becomeunavailable for an Internship or there is any other change in circumstanceswhich could affect their ability to go on an Internship;
(c)Participate in AIESEC activities within their AIESECHome Committee;
(d)Ensure that AIESEC UK has up to date email andtelephone contact details, and inform AIESEC UK as soon as possible if suchcontact details change;
(e)Ensure that AIESEC UK has up to date informationrelating to their academic or work backgrounds, including by providing anupdated CV when requested by AIESEC UK;
(f)Actively search for an Internship on the AIESECDatabase once access has been granted; and
(g)Inform the UK AIESEC National Committee of any issuesthat may arise in connection with finding an Internship through the Go Global Programme (including, but not limitedto, the need for adequate training on the AIESEC Database) as soon as possible,and in any event within one month of becoming aware of any such issue.
2.2Preparation for the Internship
(a)Attend an outgoing preparation seminar, details of which will be given toParticipants by their AIESEC Home Committee, or emailed to Participants by theUK AIESEC National Committee. Attendance at an outgoing preparation seminar iscompulsory for all Participants. If a Participant does not attend an outgoingpreparation seminar, they forfeit their right to apply for a partial refund ifthey are unable to find an Internship;
(b)Acquire the necessary legal documents to participatein any Internship in the relevant foreign country (e.g. work permit, visa,residence permit, insurance and other required documents); and
(c)Secure sufficient finances to fund:
(i)all travel and transport costs to and from the hostcountry; and
(ii)all costs incurred during the Internship, inparticular, living and accommodation expenses.
2.3During the Internship
Maintain communication with the local AIESECcommittee in thecountry of their Internship (the "AIESECHost Committee") and the AIESEC Home Committee throughout theInternship.
2.4After the Internship
(a)Attend at least one re-integration activity, details of which will be given toParticipants by their AIESEC Home Committee, or emailed to Participants by theUK AIESEC National Committee; and
(b)Complete and submit a report to the UK AIESEC NationalCommittee within one month of returning from the Internship.
3.INTERNSHIP FEE
(a)The cost of participating in the Go Global Programme is £350 (the "Internship Fee").
(b)Eligibility for any refund will be determined byAIESEC in accordance with the refund criteria as set out in the Schedule tothis Agreement (the "RefundCriteria").
(c)£200 of the Internship Fee will be non-refundable, andthe whole of the Internship Fee may be non-refundable in certain circumstances,as detailed in the Refund Criteria.
(d)Participants are entitled to complete oneInternship. If a Participant wishes toapply for a second Internship they must pay an additional fee of £250 in orderto regain access to the AIESEC Database.
4.GENERAL
(a)When a Participant is matched with an Internship, itis recommended that they do not book flights to the host country, or incur anyother costs in connection with the Internship, until they have obtained theacceptance note from the hosting organization and acquired all necessary legaldocumentation (e.g. work permit, visa, residence permit, insurance and otherrequired documents) to participate in the Internship.
(b)While AIESEC UK shall use reasonable endeavours to ensure that the providerof each Internship is of good reputation and standing, AIESEC UK makes nowarranty, representation or guarantee in respect of such provider or theInternship they are offering.
(c)If a Participant experiences any problems whilst ontheir Internship, they should contact the AIESEC Host Committee as soon asreasonably practical. If the problem isnot resolved by the AIESEC Host Committee, the Participant should then contacttheir AIESEC Home Committee as soon as reasonably practical. If the problem is still not resolved by theirAIESEC Home Committee, the Participant should then contact the UK AIESECNational Committee as soon as reasonably practical, and in any event within 2weeks of the problem occurring.
(d)AIESEC International, the AIESEC Home Committee andthe AIESEC Host Committee may only be held liable for their respectiveresponsibilities as described in this Agreement.
(e)In particular, AIESEC International, the AIESEC HomeCommittee and the AIESEC Host Committee shall not be liable:
(i)In case of refusal from any relevant authorities toprovide a visa, work permit or any other legal document or authorisation needed by the individual toparticipate in the Internship;
(ii)In case of false, inaccurate or incorrect informationprovided by the Participant or the Hosting Organisation resulting in the match/Internship;
(iii)In case of any accident incurred by the Participantduring the Internship; and
(iv)In case of any damage caused by the Participant to theHosting Organisation or to any thirdparty during the Internship.
4.2In addition, AIESEC International,the AIESEC Home Committee and the AIESEC Host Committee shall not be liable inany event:
(a)For any consequential or indirect damages, includingloss of income or profits; and
(b)Where the failure to fulfill their obligations hasbeen caused by circumstances beyond their control.
4.3AIESEC UK will not contribute tothe costs associated with any Internship.Each Participant will be solely responsible for paying such costs,unless the terms of the particular Internship provide otherwise.
4.4AIESEC UK reserves the right toterminate the membership of any Participant who fails to comply with anyprovision of this Agreement including, without limitation, those set-out insection 7 below.
5.AIESEC UK APPLICATION PROCESS
5.1To participate in the Go Global Programme,each Participant must provide the following to AIESEC UK:
(a)a completed application form, with all supportingdocumentation as requested in the form, including evidence of the Participant'sacademic qualifications, work experience and language proficiencies;
(b)a current curriculum vitae (CV);
(c)a completed preferences form;and
(d)the Internship Fee.
5.2Participants must alsoconfirm that they accept the terms and conditions of this Agreement.
5.3Acceptance onto the Go Global Programmeis at the absolute discretion of AIESEC UK.
5.4By submitting any personal data toAIESEC UK, Participants expressly consent to the use of that personal data byAIESEC UK and its affiliated national organisationsin connection with the Go Global Programme, which may involve sharing thatpersonal data with unaffiliated third parties in countries outside of theEEA. A copy of AIESEC UK's privacypolicy is available at www.aiesec.co.uk/privacy.aspx.
6. INTERNSHIP APPLICATION PROCESS
6.1In order to apply for Internshipswithin the AIESEC Database, Participants are required to create a form on the www.myAIESEC.netwebsite.
6.2Participants should seek advicefrom their AIESEC Home Committee if they experience any problems in creatingthis form.
6.3If participants continue toexperience problems creating this form, they should contact the UK AIESECNational Committee for further guidance.
6.4Participants are responsible forsearching and applying for Internships.
6.5A match between a Participant and aHostingOrganisation is only considered official when both theParticipant and the Hosting Organisation have signed and sent theirofficial acceptance note.
6.6If a Participant accepts anInternship (by signing an acceptance note, or sending an acceptance email, orgiving instructions to an AIESEC UK representative to sign/send this note/emailon their behalf), but chooses or is unable to go on that Internship, theirplace on the Go Global Programme will be forfeited and the RefundCriteria will apply. If a Participantchooses to break the match of the Internship for a reason not outlined inclause 6.7 below, they may be subject to paying any fine charged by the HostingOrganisation.
6.7A Participant can only break thematch of an Internship under the following circumstances:
(a)the Participant becomes ill and completing theInternship could be dangerous for their health;
(b)the Participant has an emergency in their closefamily (meaning the parents, grandparents, children and siblings of theParticipant). The Participant may be requested to provide proof of thisemergency. After breaking a match to an Internship due to a family emergencythe Participant is not permitted to put their exchange participant form on“Available”, or raise a new form on www.myAIESEC.net, for thefollowing six weeks; and
(c)the foreign and commonwealth office website (www.fco.gov.uk) states that they adviseagainst all travel, or advise essential travel only, to the specific country orarea that the Internship is based in.
7.MEMORANDUM OF UNDERSTANDING
7.1By accepting the terms andconditions of this Agreement, Participants confirm that they have read theprovisions of this Agreement and in particular acknowledge and agree to thefollowing:
(a)AIESEC UK has the right to reject any application tothe Go Global Programme.
(b)The Go Global Programme does not guarantee any Participant anInternship.
(c)AIESEC UK is not a job agency and does not provide anopportunity where the sole purpose is to earn money. AIESEC UK cannot cater forthose looking for a particular placement in a particular country. The Go Global Programme is also not intended as anopportunity for a career move abroad nor is AIESEC UK a vehicle for any personto permanently leave their country and AIESEC UK does not encourage theextension of Internships beyond the agreed periods.
(d)Participants cannot go on an internship within the UKor within the country of their birth (if this is outside of the UK).
(e)All information and documents that the Participantprovides in support of their application for, or continued participation in,the Go Global Programme are complete,accurate and up-to-date, including, without limitation, any languagecertification and that information or documentation relating to their academicand working backgrounds.
(f)Participants will be available for an Internship atall times between the earliest starting date and latest starting date indicatedon their application form.
(g)In order to start applying for Internships within theAIESEC Database, Participants must create a form on the www.myAIESEC.netwebsite within one month of paying their Internship Fee. If Participants experience any problemscreating this form, they must inform their AIESEC Home Committee and, if theycannot solve the problem, the UK AIESEC National Committee.
(h)If matched with an Internship, Participants will haveto make a decision as to whether to accept that Internship within eight workingdays of receiving the details of the Internship.
(i)If Participants accept an Internship (by signing aacceptance note, sending an acceptance email, or giving instructions to anAIESEC UK representative to sign/send this note/email on their behalf), butchoose or are unable to go on that Internship, their place on the Go Global Programme will be forfeited and theRefund Criteria will apply.
(j)If accepted on an Internship:
(i)Participants will be solely responsible for organising and financing the Internship,including any costs relating to travel, insurance, visas and any communicationswith the AIESEC Host Committee and the provider of the Internship;
(ii)Participants will be responsible for attending, andfinancing the travel to, an outgoing preparation seminar prior to leaving thecountry for that Internship; and
(iii)Participants will provide AIESEC UK with the datesthat they will be leaving the UK, their contact details whilst on theInternship and their expected date of return to the UK.
(k)If the provider of an Internship decides to employ theParticipant on a permanent basis in the host country, AIESEC UK will have norole in facilitating this.
(l)There is no guarantee that any salary will be paid forany Internship.
(m)Eligibility for any refund will be determined byAIESEC UK in accordance with the Refund Criteria. To qualify for any refund, Participants maybe required to demonstrate to AIESEC UK that they actively searched for anInternship on the AIESEC Database.
(n)Participants must inform their local AIESEC UK officeimmediately if they are unable to participate in the Go Global Programme for any reason.
7.2The Go Global Programmerelies heavily on Participants being honest regarding their preferences statedin their application form and their circumstances during the matching process.
7.3The Go Global Programme reliesto a large extent on Participants being proactive during the matching processand flexible over where they are willing to be placed.
7.4AIESEC UK recommends thatParticipants keep a copy of this Agreement with them to remind them of theresponsibilities of AIESEC UK and Participants, and the administrative detailsof the GoGlobal Programme.
8. GOVERNING LAW
This Agreement and anynon-contractual obligations arising out of it shall be governed by the law ofEngland and Wales and subject to the jurisdiction of the English courts.
SCHEDULE
REFUNDCRITERIA
1.Inthe event that a Participant does not find an Internship, or breaches thisAgreement, the Refund Criteria will apply.
2.Thedecision of whether to give a refund or not lies with the UK AIESEC NationalCommittee.
3.The Internship Fee
(a)Thetotal cost of participating in the Go Global Programme is the Internship Fee.
(b)TheInternship fee consists of:
(i)a£200 deposit which is non-refundable (the "Deposit"). The Deposit covers basic administration costs.
(ii)a£150 placement fee (the "PlacementFee").
4.Refund Criteria
(a)Subjectto paragraph 4(b) below, a refund of the Placement Fee, will be granted to aParticipant where:
(i)theParticipant has been entered into the AIESEC Database for a minimum of sixmonths without being matched for a suitable Internship; or
(ii)theHosting Organisation with which the Participant is matched withdraws from theInternship and no suitable alternative Internship can be found; or
(iii)the Participant becomes ill and completing theInternship could be dangerous for their health; or
(iv)the Participant has an emergency in their closefamily (meaning the parents, grandparents, children and siblings of theParticipant); and
(v)theParticipant makes a written application for the refund to OGX Support, AIESEC UK, 29-31 Cowper Street, LondonEC2A 4AT within one month of the Participant or the company withdrawing fromthe Go Global Programme stating:
(A)thefull reason for requesting a refund;
(B)theamount of refund requested;
(C)theamount of Internship Fee which they paid, the method of payment, and proof ofpayment (e.g. a copy of their receipt);
(D)thedate of the application for a refund;
(E)theParticipant's EP Id (e.g. EP-In-UK-AS-2010-1234); and
(F)anyproof which backs up the application (e.g. proof of job applications, emailcorrespondence etc.).
(b)AIESECUK reserves the right to withhold payment of a refund on fulfillment of thecriteria set out in paragraph 4(a) above where:
(i)aParticipant has rejected a match and AIESEC UK, at its sole discretion, decidesthat the match is in fact a suitable one, taking into account the requirementsoutlined by the Participant on their CV and preferences; or
(ii)AIESECUK, at its sole discretion, deems that the reason for there being no match isdue to weaknesses in the Participant's application; or
(iii)AIESECUK, at its sole discretion, deems that the reason for there being no match isdue to a lack of pro-activeness on the part of the Participant in searching forand applying for suitable Internships.
